GENERAL TERMS

1. Introduction

This Privacy Policy describes the information that CHAAK, operated by grandeclip PTE. Ltd. (with its affiliates, hereinafter referred to as the “Company”, “we”, “our,” or “us”) collects from visitors to and users of web-based, PC or mobile-based application services of the Company (hereinafter collectively referred to as the “Platform”) (the online platform service, e-commerce-related services, and all software and technologies operated and managed by the Company referred to as “CHAAK Services”) and how we use it, how we protect it, and your rights.
CHAAK does not intend to create account for users who are under the age of 16 years old or other age of majority as required by the laws of the country of your domicile.
So please do not use CHAAK and CHAAK Services if you are under such age requirement.
Capitalized terms, if not defined herein, shall have the meaning assigned to them in the Terms of Use.

2. Ability to Accept

BY ACCESSING OR USING CHAAK SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS PRIVACY POLICY AND THAT YOU UNDERSTAND YOUR RIGHTS IN RELATION TO YOUR INFORMATION AND HOW WE WILL COLLECT, USE AND PROCESS IT. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY IN GENERAL OR ANY PART OF IT, YOU SHOULD NOT USE CHAAK SERVICES.

3. How We Use Your Information

We use the information we collect about you for the following purposes:
(a) For membership management purposes, such as user identification, management of member information, handling complaints and compensations, confirmation of intent to join, and confirmation of intent to withdraw membership, as well as for implementing measures restricting usage for members violating the Terms of Use;
(b) To administer CHAAK Services (i.e. to provide CHAAK Services to you) and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes (i.e. to guarantee CHAAK Services’ stability and security) and to solicit your feedback;
(c) To enable our messenger service to function and to communicated with you;
(d) To personalize the contents that you receive and provide you with tailored content that will be of interest to you;
(e) To allow other Members to identify you as a Member of CHAAK Services, to allow you to find other Members and to connect with them on CHAAK Services, and to support the socializing function of CHAAK Services;
(f) To help us detect abuse, fraud, and illegal activity on CHAAK Services;
(g) To provide user support, preserve records for dispute resolution, handle complaints, and deliver notifications;
(h) To improve, develop CHAAK Services and facilitate product development, including new service development and establishing a service environment for privacy protection;
(i) To provide you with services based on the country settings you have chosen, such as content pushing and other content related to the chosen country settings;
(j) To use information that you provided us, such as pictures and video contents that you choose to upload on CHAAK Services, as part of our advertising and marketing campaigns to promote CHAAK Services;
(k) To enable us and our advertising partners to provide ads that may be more relevant to your interests;
(l) To measure and understand the effectiveness of the advertising we serve to you and others;
(m) To make suggestions and recommendations to you and other Members of CHAAK Services about goods or services that will interest you or them;
(n) To review pictures, images and contents posted or generated on CHAAK Services to ensure that we comply with any applicable content regulations in any relevant jurisdiction;
(o) To enforce our terms, conditions, and policies; and
(p) To comply with other applicable laws and regulations.

4. Information You Consent to Provide

We collect the minimum personal information necessary to provide CHAAK Services. You consent to provide some or all of the following personal information for CHAAK Services when you create an account or use CHAAK Services:
Registration information, such as your username, profile images, phone number, birth date, etc.;
Service usage records (recent login date, registration date, login IP address, event logs), device information (unique device identifiers, OS versions), device signals (GPS, Bluetooth signals, base stations), metadata (GPS location, camera access, content information such as photo capture location and file creation date, message information such as message type, message transmission date), cookies, and Service Usage History.
Service Usage History means information that can be automatically generated and collected by servers in the process of using the CHAAK Service or transmitted as users input information. Such information may or may not constitute personal information depending on factors such as its combination with other information and the method of processing.
Service Usage History may include content that users input and share, search terms input by users, visit and access logs, records of service abuse, location information, etc. For example, when users exchange messages, such as text, images, videos, or voice, the content is transmitted through the Company's servers to the recipient, and information such as the recipient of the content, data format, posting time, etc., which indicate the transmission format and method between the sender and the recipient, are recorded on the server. The Company generally does not use the content of transmitted messages for purposes other than transmission, but information such as service usage records may be processed for the purpose of providing CHAAK Services.
User generated contents (“UGC”), including photographs, videos, audio recordings, hashtags, comments, messages, code or other data or materials that you upload, distribute or stream on the Platform when you use CHAAK Services (e.g. uploading logs, creator information, etc.);
Messages, which include information you provide when you compose, send, or receive messages through CHAAK’s messaging functionalities. They include comments you post on other Members’ UGC pages and messages you send through CHAAK Services. Such information includes the content of the message (private chats excluded) and the messaging log, such as when it was sent, received, or read, and message participants. Please be aware that messages you choose to send to other CHAAK Members will be accessible by those Members and that we are not responsible for the manner in which those Members use or share the messages;
Network activity information, such as your browsing history(your visiting logs, etc.), search history, the date and time of visits to your profile, and information regarding your interaction with other Members;
Information about you from third-party service providers, such as advertising partners and data analytics providers;

5. How We Collect Your Information

In order to provide CHAAK Services, and improve the user experience and security of CHAAK Services, we will collect, record, store, adapt, use, share or otherwise process your personal information, when you register a CHAAK account and use CHAAK Services.
We collect your personal information on the following grounds:
(a) We need to process such information, based on your permission or authorization, to provide CHAAK Services to you;
(b) We collect when we believe it is for our legitimate interests in order to provide you better experiences with CHAAK Services.

6. How We Share Your Information

We may preserve and share with our advertising, marketing, and analytics business partners de-identified device information or statistics which cannot be used to identify you.
We may also, based on the collected data, produce and share aggregated insights that do not identify you. Aggregated data may be derived from your personal information but is not considered personal information as this data does not directly or indirectly reveal your identity.
We do not collect special categories of personal information about you (this includes details about your race or ethnicity, religious or philosophical beliefs, political opinions, trade union membership, information about your health and genetic and biometric data).
We may share your information with certain authorized third parties, while it’s necessary, to assist in the improvement and optimization of CHAAK Services such as:
Our business partners so that we can improve CHAAK Services, including inter-platform linking, uploading and managing UGC, user experience activities, user services, etc.;
Our technology partners help in preventing illegal uses, increasing user numbers, operating system development, engineering and analysis of information or for our internal business purposes;
Service providers to transfer or preserve data; and
Our advertising, marketing, and analytics business partners de-identified device information or statistics which cannot be used to identify you.
Except for the above, we will not disclose or share with any third party your personal information, unless under the following circumstances:
If we obtained your consent, either implied or express;
If we are required to do so in order to comply with the applicable laws and regulations and government requests;
If we believe in our good faith that this is necessary to protect the public interest;
If it is necessary to do so to protect the safety and fundamental rights of another person;
If it is necessary to address fraud, security, or technical issues; and
If it is necessary to ensure the enforcement of our terms and conditions and the daily operation of CHAAK Services.
The company outsources the following tasks to external companies for service provision, ensuring that the contracted companies manage and supervise the processing of personal information safely in compliance with relevant laws. Furthermore, if there are any changes to the subcontractors or the contents of the outsourced tasks, we will notify you through this Privacy Policy. If you wish to refuse the outsourcing of personal information processing, you may terminate your membership through the delete account process to cease using the Service.

7. How Long We Keep Your Information

We retain your information for as long as it is necessary to provide you with CHAAK Services so that we can fulfil our contractual obligations and rights in relation to the information involved, or for other legitimate purpose such as complying with our legal obligations, resolving disputes, and enforcing our agreements.
We use the following criteria to determine the period for which we will keep your information:
Our contractual obligations and rights in relation to the information involved;
Obligation(s) under the applicable laws and regulations to retain data for a certain period of time;
Statute of limitations under the applicable laws;
Our reasonable business purposes; and
Disputes or potential disputes.
Because these needs vary for different type of information, the context of our interactions with you or your use of CHAAK Services result in different retention periods for different type of information.
Where we do not need your information in order to provide CHAAK Services to you, we retain it only for so long as we have a reasonable business purpose in keeping such data.

8. Procedures and Methods for Personal Information Disposal

When a Member requests deletion of personal information, withdraws consent for the collection and use of provided personal information, or when the purpose of collection and use has been achieved, or the retention and use period has expired, the personal information of the relevant Member will be promptly disposed of in accordance with this Privacy Policy and the Terms of Use.
(a) Disposal Procedure: The Company identifies the personal information for disposal and obtains approval from the Company's Personal Information manager before proceeding with the disposal.
(b) Disposal Method: Personal information stored in electronic file formats will be deleted using technical methods that render the records irretrievable. Personal information printed on paper will be destroyed using a shredder.
In cases where the Company is obligated to continue retaining personal information despite the expiration of the consented retention period or the achievement of the processing purpose, the Company will transfer such personal information to a separate database or store it in a different location for continued retention, in compliance with other applicable laws.

9. Third-party Applications

CHAAK Services may allow you to access to content, products or services offered by third parties through hyperlinks (in the form of word link, banners, channels or otherwise), API or otherwise to such third parties' web sites.
You are cautioned to read such web sites' terms and conditions and/or privacy policies before using the Sites.
You acknowledge that CHAAK has no control over such third parties' web sites, does not monitor such web sites, and shall not be responsible or liable to anyone for such web sites, or any content, products or services made available on or through such web sites.

10. Your Rights

In accordance with the applicable laws and regulations of the jurisdiction where you reside, you may have some or all of the following rights:
(a) Members may change their profile name and profile picture on the Platform at any time through the "My Page" section, and may also view, modify, or delete their personal information.
(b) Members may request access to, modification, or deletion of their personal information via the Company's official email address, official@chaak.me Please note that verification procedures may be required during this process.
(c) Members may request cessation of personal information processing from the Company via the Company's official email address, official@chaak.me However, the Company may refuse to comply with the cessation request in cases where there are specific provisions in the law or other reasonable grounds.
(d) Members may withdraw consent for the collection and use of personal information at any time through actions such as delete account. In such cases, information that is no longer necessary for the operation and provision of the CHAAK Services will be deleted from the server. Please note that if Members only delete the CHAAK app from their device without using the delete account function, their information will not be deleted. Additionally, withdrawal of membership will not affect information related to groups created by the Member or copies of messages sent by the Member to other Members.
(e) In cases where Members request correction of personal information errors, the Company will refrain from using or providing such personal information until the correction is completed. Furthermore, if incorrect personal information has already been provided to a third party, the Company will promptly notify the third party of the correction results to ensure that the correction is implemented.
(f) Members and their legal representatives may directly process their rights through the member information page or request them via the Company's official email address, official@chaak.me
Please be aware that once your account is deleted, restoration of your account and all historical data on CHAAK Services will not be possible (due to variances in applicable laws, data erasure may occur after a certain period).
You acknowledge and understand that certain behavioral data will be anonymized for statistical research purposes. Additionally, it is important to note that third parties may retain backups of your information. We are unable to control or monitor the policies or actions of third-party products, services, data collection, and storage.

11. How We Transfer Your Information

We maintain servers around the world and your information collected by us are firstly stored and processed in servers nearest to your region; however, in specific cases your information may be stored and processed in another country or area where we maintain data collection facilities. We have complied with relevant applicable data localization rules with respect to our data transfer practices.
We take appropriate steps to ensure that the information we collected is processed in accordance with the Privacy Policy and the relevant applicable laws and regulations.
If we provide any information about you to any legal agency, we will take appropriate measures to ensure such receiving institutes protect your information adequately in accordance with this Privacy Policy and the applicable laws.

12. Security of Your Information

We implement appropriate administrative, technical, and physical security measures to protect your personal information from unauthorized access and disclosure.
(a) Encryption of User Information
User passwords are stored and managed using one-way encryption, and verification and modification of personal information can only be done by the Member who knows the password. We establish and apply password creation rules to avoid using easily guessable numbers such as the Member's birthday or phone number.
(b) Protection Against Hacking and Computer Viruses
We operate intrusion prevention systems 24/7 to prevent leakage or damage of user personal information due to hacking or computer viruses. Additionally, we continuously research and apply new hacking/security technologies to our services.
(c) Minimization and Education of Personal Information Handlers
We limit the number of personal information handlers and raise awareness of the importance of personal information protection through education and other administrative measures.
(d) Physical Surveillance and Blocking
We install and physically monitor and block access to areas where personal information is stored, such as data storage rooms, to control external access.
(e) Establishment and Implementation of Internal Personal Information Protection Plans
We establish and periodically review internal personal information management plans, including the designation of a personal information protection manager and the organization and operation of the personal information protection group.
(f) Retention and Prevention of Forgery or Alteration of Personal Information Access Records
We retain and manage records of personal information system access by personal information handlers and conduct long-term checks on access records to prevent misuse, loss, forgery, or alteration of personal information. We securely store access records to prevent them from being forged, altered, stolen, or lost.
Please be advised, however, that we cannot fully eliminate security risks associated with the storage and transmission of your personal information.
You should use caution whenever submitting information through CHAAK Services and take special care in deciding which information you provide us with.
You are responsible for maintaining the secrecy of your password and account information at all times.

14. Children Protection

CHAAK Services is not directed to children, and if you are under the age of 16 years old or other age of majority as required by the laws of the country of your domicile, you may not create a CHAAK account or use CHAAK Services.
We have zero tolerance to any form of child abuse or exploitation. Your data (including messages) may be shared with legal agencies if we in our good faith believe that you have engaged in child abuse, or if we are requested to do so by relevant legal agencies.

15. Modifications

We may amend any of the terms of the privacy policy by posting the terms. We will also update the “Last Updated” date at the top of this policy, which reflects the effective date of such policy. Your continued access to or use of CHAAK Services after the date of the updated policy constitutes your acceptance of the updated policy. If you do not agree to the updated policy, you must stop accessing or using CHAAK Services.
